Privacy Policy

The Gramm-Leach-Bliley Act was enacted to address concerns relating to customer financial privacy. The Gramm-Leach-Bliley Act required the Federal Trade Commission (FTC) and other government agencies that regulate financial institutions to implement regulations to carry out the Act’s financial privacy provisions (GLB Act). The regulations required all covered businesses to be in full compliance by July 1, 2001.  It is the express policy of the Company to comply with these requirements.

On December 1, 2009, the Federal Trade Commission (Commission), together with seven other federal agencies, published in the Federal Register amendments to the rules implementing certain privacy provisions of the Gramm-Leach-Bliley Act (GLB Act) and adopting a model privacy form. The GLB Act and the Commissions Privacy Rule, 16 CFR Part 313, require certain financial institutionsto provide initial and annual privacy notices to their customers. These financial institutions include, but are not limited to, mortgage lenders, finance companies, mortgage brokers, wire transferors, collection agencies, credit counselors and other FTC regulated entities.

As an FTC regulated entity, the Company is required to provide notice to its customers of the Companys information collection and sharing practices and inform customers of their right to opt out of certain of these practices.

The Company has adopted and modified the FTC model privacy notice as set forth in the following Schedule A (the Privacy Notice), disclosing to our customers the Companys policy with respect to the Companys treatment and usage of nonpublic personal information.

Pursuant to FTC regulations, FTC regulated entities that utilize the model privacy form will satisfy the disclosure requirements for privacy notices under the GLB Act and the Privacy Rule (i.e., will obtain a safe harbor).

The Company is required to present the Privacy Notice in a way that is clear, conspicuous, and intact, so that a customer can retain the content of the Privacy Notice.  In addition, the Company is required to provide the Privacy Notice to customers using the same page orientation (portrait), format, and order of elements as provided in the attached Schedule A.  The Company may not change the content of the form or add any information, except as specifically permitted in the instructions to the form as made available by the FTC (see  The Company may customize the Privacy Notice as permitted pursuit to these instructions.

Questions about the Company’s Customer Privacy Policies and Procedures may be directed to the Compliance Officer.
